OpenOperator Pty Ltd (ABN pending) ("Open Operator", "we", "us", or "our") is committed to protecting your personal information in accordance with the Privacy Act 1988(Cth) and the Australian Privacy Principles (APPs). This Privacy Policy explains how we collect, use, disclose, and store your personal information when you use the Open Operator platform, community, and related services (the "Service").

- Identity information: your name, email address, phone number, company name, job title, and industry.
- Payment information: billing details processed securely via Stripe. We do not store your full credit card number on our servers.
- Usage information: how you interact with the Service, including pages visited, features used, onboarding progress, sprint participation, and community engagement.
- Device and technical information: IP address, browser type, operating system, and device identifiers.
- Marketing attribution: UTM parameters and referral source data used to understand how you found us.
- Community content:information you voluntarily share in the community, such as posts, comments, and "Show Your Agent" presentations.
2. How We Collect Information
We collect personal information:
- Directly from you when you register, subscribe, complete onboarding, or interact with the Service.
- Automatically through cookies, analytics tools, and server logs when you use the Service.
- From third-party services such as Stripe (payment processing) and Circle.so (community platform).
3. How We Use Your Information
We use your personal information to:
- Provide, maintain, and improve the Service.
- Process payments and manage your subscription.
- Configure and support your AI agent setup.
- Send transactional communications (welcome emails, payment confirmations, sprint notifications).
- Send marketing communications where you have consented or where permitted under the Spam Act 2003 (Cth). You can opt out at any time.
- Analyse usage patterns to improve the Service and develop new features.
- Comply with legal obligations and resolve disputes.
- Protect the safety and security of our members and the Service.
4. Disclosure of Information
We may share your personal information with:
- Service providers: third-party providers who assist us in operating the Service, including Stripe (payments), Resend (email), Twilio (SMS), Circle.so (community platform), and AWS (hosting). These providers are contractually obligated to protect your information.
- Legal requirements: where required by law, regulation, legal process, or governmental request.
- Business transfers: in connection with a merger, acquisition, or sale of assets, in which case your information may be transferred to the successor entity.
We do not sell your personal information to third parties.
5. Overseas Disclosure
Some of our service providers operate outside Australia, including in the United States. In accordance with APP 8, before disclosing personal information to an overseas recipient, we take reasonable steps to ensure the recipient handles your information in a manner consistent with the APPs. By using the Service, you consent to the transfer of your information to these jurisdictions.

We use cookies and similar technologies to enhance your experience, remember your preferences, and analyse usage. You can control cookie settings through your browser. Disabling cookies may affect the functionality of the Service.
7. Data Security
We implement industry-standard security measures to protect your personal information, including encryption in transit (TLS), secure payment processing, access controls, and regular security reviews. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

We retain your personal information for as long as your account is active or as needed to provide the Service. After account closure, we may retain certain information for a reasonable period to comply with legal obligations, resolve disputes, and enforce our Terms. Payment records are retained as required by Australian tax law.

In accordance with the Notifiable Data Breaches (NDB) scheme under Part IIIC of the Privacy Act 1988, we will notify the OAIC and affected individuals if we experience an eligible data breach that is likely to result in serious harm.
11. Children's Privacy
The Service is not directed at individuals under 18 years of age. We do not knowingly collect personal information from children. If we become aware that we have collected information from a child, we will take steps to delete it promptly.

We may update this Privacy Policy from time to time. We will notify you of material changes via email or through the Service. The "Last updated" date at the top reflects the most recent revision.
